1.  Scope of application and validity of these general terms of use

1.1. These general terms and conditions of use („Terms of Use„) of „Die Presse“ Verlags-Gesellschaft m.b.H. & Co KG („Die Presse“ for short) apply to the use of the website www.europeanvoices.eu including all associated and any related mobile applications subdomains (together „Website„ or „Services„ for short) by persons („User„, m/f/x, or „you“ for short).

1.2. By using the website, the user agrees to these terms of use without restriction.

1.3. Die Presse reserves the right to amend or change these terms of use at any time (in short „changes„). These amendments shall take effect upon publication of the amended Terms of Use. To the extent permitted by law, Die Presse is not obliged to inform the user separately of amendments. However, the user can always call up the current version of the Terms of Use on the website. The version of the Terms of Use valid at the time of use shall be authoritative.

2. Content and purpose of the services

European Voices is a European debate magazine focussing on foreign and security policy. It aims to illuminate the major geopolitical debates from a European perspective. Users are provided with news on current political events and other editorial content. Other press services, in particular the „Die Presse“ online shop („Presse-Shop“ for short), can be accessed via the website. The use of these services is subject to the currently valid terms and conditions of these services. The terms and conditions of the Presse-Shop are available here. Furthermore, the website of companies affiliated with „Die Presse“ or services of other third-party providers (collectively „external services„) can be accessed. The use of external services by the user is at the user‘s own risk and subject to the terms and conditions of the respective third-party provider. Unless expressly stated otherwise by „Die Presse“, Die Presse is neither a party to a transaction between the user and the third-party provider, nor a representative or agent, nor an intermediary or broker. Die Presse therefore also assumes no liability for the topicality, correctness, completeness, quality, suitability (e.g. redeemability of vouchers) etc. of goods, services or digital content from third-party providers that are made accessible to the user on the services or via links to third-party provider websites. Advertisements from third-party providers on the website do not constitute a binding offer from „Die Presse“. Any business transaction/contract is concluded exclusively between the advertiser or the third party named in the advertisement and the user who accepts the offer. Die Presse shall not be liable for the realisation or non-realisation of such a transaction/contract or for any claims of any kind whatsoever in connection therewith (e.g. warranty, damages, claims for action or omission, etc.).

3. Generally accessible services

3.1. Unless otherwise specified (e.g. certain restrictions), the service is available to any user who has the technical equipment required to use the service. Die Presse does not guarantee that the service is or will remain compatible with the user‘s technical equipment. It is the responsibility of the user at all times to have the technical equipment required to use the service.

3.2. The service is currently offered free of charge. However, Die Presse reserves the right to charge a fee for the service or individual services (e.g. access to certain content) at any time, or to extend, restrict or discontinue the service or individual services without giving reasons. If an individual service is only available for a fee, Die Presse will point out the obligation to pay before the service is used. Services without such a notice are free of charge.

4. Availability of the service, warranty and liability

4.1.  Die Presse accepts no liability for the constant availability of the free service. Die Presse shall not be liable for information, communication, programmes, software and other materials (collectively „content„) provided as part of the free service, nor for damages arising from the use of this content, unless such damages are caused by intentional or grossly negligent breach of legal obligations applicable to „Die Presse“ or of material contractual obligations of „Die Presse“. The above provision applies to all types of damage, in particular damage caused by errors, delays or interruptions in transmission, incorrect or incomplete content, loss, misuse or deletion of data, viruses, Trojans or other malware or which may arise in any other way when using the service. Die Presse is not responsible for the costs of purchasing or installing the necessary hardware and software components, nor for the quality and costs of connecting the user‘s end device (iPad, smartphone, etc.) to the Internet. This applies in particular to any roaming charges for Internet connections abroad. The following does not apply to consumers, but only to entrepreneurs as users: Die Presse provides no guarantee with regard to the compatibility of the service with the user‘s hardware or software components.

4.2. If services are made available for a fee, Die Presse shall be liable — unless separate contractual conditions exist (e.g. subscription contract) — for damages caused by wilful or grossly negligent breach of legal obligations affecting „Die Presse“ or of material contractual obligations of „Die Presse“. The above provision applies to all types of damage, in particular damage caused by errors, delays or interruptions in transmission, incorrect or incomplete content, loss, misuse or deletion of data, viruses, Trojans or other malware or which may arise in any other way when using the service.

4.3. For legal reasons, the retrievability or availability of individual articles, photos, etc. or pages may not be given.

5. Third-party content

Die Presse is solely responsible for content created or adopted by „Die Presse“ itself and published, made publicly available or distributed on the website. This does not include content from third parties (including content made accessible by these third parties from other authors, authors or distributors) that is made accessible to the user directly on the website or indirectly (e.g. via links). Links to the website by the user must be managed as external links and reproduce entire pages (including navigation frames). The transfer of content into your own frames is not permitted. Where links to other websites are provided, Die Presse accepts no responsibility whatsoever, to the extent permitted by law, either for the content (e.g. content that violates legal provisions or common decency, incorrect or incomplete content) of these websites or for damages arising from the use of linked information. Under no circumstances shall Die Presse be liable for any loss or damage incurred by the user, in particular as a result of reliance on information obtained through the use of the service or as a result of links to other websites. Claims of any kind whatsoever that are based on third-party content are therefore not to be addressed by the user to Die Presse, but always directly to the respective third party. As soon as Die Presse becomes aware of the illegality in connection with the link, Die Presse will remove the link in question from the services.

6. Rights to content /transfer of content

6.1. The content accessible via the Service may be protected by copyright and/or patents, trademarks and/or other intellectual property rights (collectively referred to as „intellectual property rights„). Their use is subject to the applicable copyright and other protective laws. Further distribution is generally prohibited and only permitted in exceptional cases on request and with the express authorisation of the rights holder.

6.2. All rights to the selection, coordination, arrangement and expansion of this content belong to Die Presse.

7.  Social media

7.1. Each user of any share function provided (email, Facebook, Twitter, WhatsApp, etc.) bears full responsibility for the content of all messages they send. All applicable laws and in particular the applicable General Terms and Conditions of the respective platform must be complied with. Die Presse bears no responsibility for the content of messages sent.

7.2. By clicking on the respective Follow button, the user is directed via the website to the social media of European Voices in the social networks (e.g. Facebook). The data protection guidelines of the individual social networks apply to the processing of user data triggered by a visit to a European Voices presence on the social networks.

8. Data protection/IT security

8.1. Insofar as the user‘s personal data is processed when using the service, this is done on the basis of the information provided separately to the user in accordance with Article 13 or Article 14 of the General Data Protection Regulation, including information on IT security („data protection information“ for short). The current version of the data protection information can be viewed by the user at any time here. Die Presse shall only be liable for unauthorised access or misuse of the User‘s data by third parties (e.g. in connection with a hacker attack) if the unauthorised access or misuse is solely attributable to the fact that Die Presse has failed to take appropriate and reasonable security measures, at least due to gross negligence.

8.2. Die Presse reserves the right to pass on the user‘s data to government agencies, law enforcement authorities or other institutions authorised to take legal action in accordance with section 14 of the Law on Unfair Competition (UWG), such as the police, courts, authorities, protection associations against unfair competition, etc., as well as to transmit the necessary data of the user at the request of courts, competent authorities or third parties, insofar as this is provided for by the relevant statutory provisions (in particular claims for information in accordance with the ECG).

9. Final provisions

9.1. These Terms of Use contain all rights and obligations relating to the use of the service. Other agreements or declarations of intent between Die Presse and the user must be made in writing to be legally effective. This also applies to any amendment to the written form requirement.
 
9.2. The following does not apply to consumers, but only to entrepreneurs as users: Should individual provisions of the contract, including these Terms of Use (including this provision), be or become invalid in whole or in part, the validity of the remaining provisions or the remaining parts of such provisions shall remain unaffected. The invalid provision or the invalid parts shall be replaced by a valid provision that comes as close as possible to the original provision. This also applies to any unforeseen loopholes in the contract, including these terms of use.

9.3. Austrian substantive law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the conflict of laws rules of private international law. In the case of consumers, this choice of law shall only apply insofar as mandatory provisions of the law of the state of the European Union in which the consumer has his habitual residence are not superseded.

9.4. Not for consumers, but exclusively for entrepreneurs as users: For all disputes arising from and in connection with the contract, including these terms of use, as well as the conclusion and termination of the contract, the exclusive jurisdiction of the competent court in Vienna is agreed.
